Default please help with argument having at work

Heya I work in a nursery thats ran by a mother and her untrained unqualified 20 year old daughter. She has no qualifications at all but is currently doing her level 3 in childcare.
Now she has the babies unsupervised (which in my book is very wrong ) but her mum also now claims that as she is in training for a level 3 it doesn't matter as its the same as being qualified and in her eyes she is already a level 3 so can act as one.
I say no its wrong and by law she should have a qualified member of staff with her at all times and until she has qualified it should always be that way.
Who is right??

I believe you are. Until CWDC say she's level 3, she's not. She could not drive a car without someone with her until she had passed!!
